IMPORTANT ENTERTAINMENT & COMMUNITY NOTICE: Would You Rather is an interactive social party and dilemma game provided strictly for entertainment purposes. User-submitted dilemmas reflect the opinions of their authors and do not represent our views. We maintain strict zero-tolerance policies against objectionable or abusive content.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Would You Rather mobile application (the "App") or accessing https://wouldyourather.one/, provided by Would You Rather ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use and End User License Agreement ("Terms" or "EULA"). If you do not agree to these Terms, do not access or use the App.

2. End User License Agreement (EULA)

Would You Rather grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited license to install and use Would You Rather on Apple-branded devices that you own or control, solely for personal, non-commercial entertainment purposes, strictly in accordance with the Apple Media Services Terms and Conditions (Usage Rules).

  • Scope of License: You may not copy, reverse engineer, decompile, disassemble, attempt to derive source code, modify, or create derivative works of the App or any updates, except to the extent permitted by applicable law.
  • Reservation of Rights: All intellectual property rights, titles, and interests in and to Would You Rather, including game designs, questions, graphics, and trademarks, remain our exclusive property.

3. Apple Standard EULA & Third-Party Beneficiary Terms

You acknowledge and agree that this Agreement is entered into between you and Would You Rather only, and not with Apple Inc. ("Apple"). As an App Store customer:

  • Standard EULA Precedence: These Terms incorporate by reference the Apple Standard End User License Agreement (Standard EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict or inconsistency between these Terms and Apple's Standard EULA, the terms of Apple's Standard EULA shall govern.
  • Apple as Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Maintenance & Support: Would You Rather is solely responsible for providing all maintenance and customer support services for Would You Rather. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • Product Claims: Would You Rather, not Apple, is responsible for addressing any claims relating to the App or your possession and use thereof, including but not limited to product liability claims, consumer protection, and regulatory compliance.
  • Third-Party IP Infringement: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Would You Rather, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.

4. Description of Service & User-Generated Content (UGC)

Would You Rather provides users with interactive hypothetical dilemmas, voting statistics, game categories, party modes, and the ability to submit custom dilemma questions.

  • Content Moderation: In compliance with Apple App Store Review Guidelines (Guideline 1.2), we enforce zero tolerance for objectionable content, hate speech, bullying, defamation, explicit sexual content, or harassment. All submitted questions are subject to automated filtering and editorial moderation.
  • Reporting & Blocking: Users may report any inappropriate question or user directly in the App. Reported content is reviewed promptly, and offending content will be removed within 24 hours.
  • License to Submissions: By submitting questions or suggestions to the App, you grant Would You Rather a worldwide, royalty-free, perpetual license to use, display, modify, and publish the questions within the App.

5. In-App Subscriptions & Purchases

Would You Rather may offer auto-renewing subscriptions ("Would You Rather Club" or "VIP Pass") and one-time in-app purchases that unlock ad-free gameplay, exclusive categories, and unlimited question submissions.

  • Billing: Payment is charged to your Apple ID Account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renewal is canceled at least 24 hours before the end of the current billing cycle.
  • Account Renewal: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate specified for your selected plan.
  • Managing Subscriptions: You can manage, upgrade, downgrade, or cancel your subscription at any time in your iOS Device Settings > Apple ID > Subscriptions.
  • Refunds: All purchases and refund requests are processed and governed directly by Apple according to Apple Media Services Terms and Conditions.

6. User Accounts & Registration

Optional account features require authentication via Sign in with Apple. You agree to maintain the security of your credentials and are responsible for all activities under your account. You may permanently delete your account and all associated data at any time directly in the App under Settings > Delete Account.

7. Prohibited Conduct

You agree not to:

  • Abuse & Harassment: Submit defamatory, obscene, sexually explicit, hateful, or abusive content;
  • Exploitation: Attempt to scrape questions, reverse-engineer game mechanics, or manipulate community voting results;
  • System Disruption: Introduce viruses, automated bots, or scripts that disrupt app infrastructure;
  • Impersonation: Impersonate any person, brand, or entity.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Would You Rather and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, content posted by third parties, or service interruptions.

9. Legal Compliance & Export Controls

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate revisions by updating the "Last Updated" date at the top of this document or via in-app notifications. Continued use of the App constitutes your acceptance of the updated Terms.
